State law
Paternity law in Pennsylvania.
Pennsylvania's paternity law is found in 23 Pa.C.S. §5102 and §5104. Paternity is established by marriage, by an acknowledgment of paternity filed with the Department of Health, or by genetic testing in a court action. The Domestic Relations Code presumes paternity for children born to married parents. Genetic testing performed by AABB-accredited laboratories is admissible in all Pennsylvania family courts. The Pennsylvania Bureau of Child Support Enforcement coordinates testing in state-administered child support actions.
