Paternity law in New York.
New York paternity law is governed by Article 5 of the Family Court Act and Domestic Relations Law §24. The marital presumption applies but may be rebutted by clear and convincing evidence. Acknowledgments of Paternity filed with the New York State Department of Health establish legal paternity outside of court. Genetic testing under §532 of the Family Court Act is routinely ordered in contested actions and is admissible from any AABB-accredited laboratory. Challenges to an acknowledgment must be filed within 60 days of signing, with later challenges only available in cases of fraud, duress, or material mistake of fact.
